This Acceptable Use Policy sets out the rules for using any software platform, application, or hosted service that FourSix46 Global Ltd (trading as Stack46), company number 16712658, builds, deploys, or operates — whether for our own ventures or on behalf of a client. It applies alongside our Terms of Service and exists to keep every platform we build or run safe, reliable, and lawful for everyone who uses it.
This Acceptable Use Policy ("AUP") applies to any website, application, platform, or system built, deployed, hosted, or operated by FourSix46 Global Ltd (trading as Stack46), company number 16712658, registered in England and Wales ("we", "us", "Stack46"). It applies whether you are a visitor to our own websites, a client engaging us for development or hosting work, or an end user of a platform we have built or operate on a client's behalf. This AUP is incorporated by reference into our Terms of Service and forms part of the binding agreement between you and us. Where a signed client contract or statement of work contains more specific acceptable-use terms for a particular engagement, those terms take precedence for that engagement, with this AUP applying to anything not otherwise addressed.
"Platform" means any website, application, API, or system covered by this policy. "User" means any person or entity accessing or using a Platform, including visitors, registered account holders, and end users of client products. "Client" means an organisation or individual that has engaged Stack46 to build, deploy, or operate a Platform. "Content" means any data, text, files, code, or material submitted, uploaded, or transmitted through a Platform by a User.
You may not use any Platform to: distribute malware, ransomware, or other malicious code, or attempt to gain unauthorised access to systems, accounts, or data; infringe another party's intellectual property rights, privacy rights, or confidentiality obligations; send unsolicited bulk communications, spam, or engage in phishing; scrape, harvest, or extract data at a scale or in a manner not authorised by the Platform's terms or by us; probe, scan, or test the security of a Platform without prior written authorisation (see Section 6, Security Testing); misrepresent your identity or affiliation, or impersonate any person or organisation; upload, transmit, or facilitate access to illegal content, including but not limited to child sexual abuse material, content that incites violence or terrorism, or content that violates applicable UK law; trade in goods or services that are unlawful, regulated, or restricted (including controlled substances, weapons, or counterfeit goods) without the required licences; or use a Platform in breach of applicable export control or trade sanctions law, including UK and EU sanctions regimes.
Platforms that share infrastructure, bandwidth, or compute resources across multiple Users or Clients are subject to fair-use limits designed to protect service quality for everyone. Automated or excessive use that degrades performance for other Users, circumvents rate limits, or places unreasonable load on shared infrastructure is prohibited and may result in throttling, suspension, or termination of access without prior notice where necessary to protect the Platform or other Users.
Users are solely responsible for the Content they submit, upload, or transmit through a Platform. We do not undertake to pre-screen Content but reserve the right, at our sole discretion, to review, remove, or restrict access to any Content that we reasonably believe violates this policy, applicable law, or a third party's rights, and to do so without prior notice where the Content poses an immediate risk.
Unauthorised security testing of any Platform, including penetration testing, vulnerability scanning, or load testing, is prohibited and may constitute an offence under the Computer Misuse Act 1990. If you have identified, or wish to test for, a security vulnerability, you must first obtain written authorisation from us and follow the scope and rules of engagement we provide, or report it through our responsible disclosure process described on our Security page. Good-faith reports made through that process, within its stated scope, will not result in legal action against the reporter.
Any processing of personal data through a Platform must comply with the UK General Data Protection Regulation, the Data Protection Act 2018, and our Privacy Policy. Users and Clients must not use a Platform to collect, process, or disclose personal data unlawfully, or in a manner inconsistent with the purposes for which it was collected. Confidential information obtained through use of a Platform must not be disclosed to third parties without authorisation.
We may monitor use of our own Platforms for security, quality, and compliance purposes, and we may investigate suspected violations of this policy. Where a violation is identified, our response is proportionate to its severity: minor or first-time issues typically receive a warning and an opportunity to correct the behaviour; repeated or more serious violations may result in suspension or termination of access; violations involving illegal activity, security threats, or immediate risk to others may result in immediate suspension without prior warning. We reserve the right to report unlawful activity to the relevant authorities and to cooperate with law enforcement investigations.
If you believe a Platform is being used in violation of this policy, please report it to hello@stack46.com with as much detail as possible, including URLs, timestamps, and a description of the issue. We aim to acknowledge reports promptly and to take appropriate action based on the severity of the issue reported.
This Acceptable Use Policy should be read alongside our Terms of Service, Privacy Policy, and Security page, each of which forms part of the terms governing use of our Platforms. In the event of a direct conflict between this policy and a signed client agreement, the signed agreement governs for that engagement.
We may update this Acceptable Use Policy from time to time to reflect changes in our services, technology, or legal obligations. The effective date at the top of this page will be updated when changes are made. Continued use of a Platform after an update constitutes acceptance of the revised policy.
